Terms and Conditions for the Members Area

  1. Access to the members area is granted immediately upon payment confirmation.

  2. Carefully review the plan purchased and the benefits it offers.

  3. Reproduction, partial or full, or commercial distribution of this content without prior authorization is strictly prohibited. Our projects are protected by intellectual property rights, and thus, the sale, donation, transfer, sharing, or any form of distribution or reproduction of this content is forbidden.

  4. The floor plans provided in the members area are for inspiration purposes only and are not sufficient for municipal approval. The client must hire a trusted architect/engineer to formalize the process.

  5. Plan payments are monthly and recurring. Membership can be canceled at any time upon request.

Terms and Conditions for Ready-to-Use Projects in the Store

  1. Products will be delivered within 7 business days after payment confirmation. Please verify the availability and delivery time for each product at the time of purchase. All products will be sent according to the delivery method chosen by the customer.

  2. Check the product(s) upon delivery and ensure that the product matches your order. If there are any discrepancies, please contact us immediately.

  4. The projects sold are standardized and must be adapted to local regulations by a professional of your choice. These projects comply with the current ABNT and NBR national standards. For specific municipal adaptations, please request a complementary quote.

  5. For construction and municipal approval, the client must hire a trusted architect/engineer to formalize the process.

  6. You are allowed to hire a professional of your choice to make adjustments to the project after delivery. If needed, request a complementary quote for this service.

  7. Each project purchased allows for the construction of only one building. It is not permitted to construct multiple buildings from a single project.

Terms and Conditions for Custom Online Projects

CONTRACTED PARTY: Elcio Massuo Onohara Arquitetura e Planejamento - CNPJ: 33.848.520/0001-08.
CONTRACTING PARTY: An individual or legal entity that received a commercial proposal from the CONTRACTED PARTY and completed the payment, thereby formalizing the service agreement.

We emphasize the importance of goodwill between the parties to ensure a harmonious and effective project process. Thus, it is essential that the CONTRACTING PARTY clearly communicates their ideas and needs to foster the creativity of the professionals involved. If no mutual agreement is reached, the contract clauses outlined below will apply.

CONTRACTED PARTY and CONTRACTING PARTY mutually agree to the following terms for the customization of projects:

Clause 1 – Subject of the Contract
1.1. The CONTRACTED PARTY will execute only the tasks agreed upon and communicated via email or WhatsApp by the CONTRACTING PARTY before the issuance of the finalized commercial proposal. This includes architectural and complementary projects (Interior Design, Electrical, Hydraulic, Cistern, Septic Tank, and Quantitative Budget – if contracted).

Clause 2 – Project Specifications
2.1. The CONTRACTED PARTY will draft a project proposal based on the description provided by the CONTRACTING PARTY. The CONTRACTING PARTY may approve, reject, or request up to three (3) alternative proposals.
2.2. After approving the floor plan, the CONTRACTING PARTY may request changes or modifications up to ten (10) times, as long as they remain within the scope of the consolidated proposal.
2.3. Any additional modifications not included in the consolidated proposal will require a new quote.
2.4. 3D Facade: The model will only begin development after the floor plan is approved. Once development starts, reverting to the previous stage is not possible. The 3D facade model includes up to three (3) proposal options.

  • 2.4.1. For modification projects (alterations to ready-made projects), 3D facade modeling is excluded unless specified in the consolidated proposal.

  • 2.4.2. For new projects, a 3D facade model will be created.
    2.5. Complementary Projects (Interior Design, Electrical, Hydraulic, Cistern, Septic Tank, and Quantitative Budget) if contracted:

  • 2.5.1. For modification projects, complementary elements will be adjusted to the architectural changes.

Clause 3 – Deadlines and Project Execution

3.1. Project Development Stages:

3.1.1 - Preparation of the Floor Plan proposal.
3.1.2 - Period for review and, if requested by the CONTRACTING PARTY, adjustments to the Floor Plan proposal.
3.1.3 - Approval of the Floor Plan by the CONTRACTING PARTY.
3.1.4 - Preparation of the 3D Facade proposal.
3.1.5 - Period for review and, if requested by the CONTRACTING PARTY, adjustments to the 3D Facade proposal.
3.1.6 - Approval of the 3D Facade by the CONTRACTING PARTY.
3.1.7 - Final delivery via email (which can also be made in printed format via mail if contracted).

3.2. The CONTRACTED PARTY must comply with the deadlines for each stage as follows:

3.2.1 - Floor Plan proposal within 7 business days.
3.2.2 - 3D Facade proposal within 7 business days.
3.2.3 - Interior Design proposal within 7 business days per room (if contracted).
3.2.4 - Architectural Project within 20 business days.
3.2.5 - Interior Design Project within 7 business days per room (if only one room is contracted, the deadline will be 15 business days).

If the CONTRACTING PARTY requests a new proposal, the deadline for the respective stage will be restarted. Deadlines are cumulative, starting only after the CONTRACTING PARTY approves the previous stage.

All contracted projects will be delivered together, respecting the total sum of the deadlines described above. If the CONTRACTING PARTY requests and the CONTRACTED PARTY deems it possible, the projects can be delivered separately as they are completed.

3.3. The CONTRACTING PARTY must approve or request changes to the stages (items 3.1.3 and 3.1.6) within a maximum period of 30 days. If no response is given within this period, the current service will be canceled due to abandonment by the CONTRACTING PARTY, and there will be no total or partial refund.

3.4. The following items are included:

3.4.1 - Architectural Project
3.4.1.1 Floor Plan
3.4.1.2 Roof Plan
3.4.1.3 Front Facade Elevation
3.4.1.4 3D Images of the Front Facade (if contracted)
3.4.1.5 Window and Door Schedule
3.4.1.6 Internal Sections
3.4.1.7 Project in PDF and CAD (DWG)

3.4.2 - Interior Design Project (if contracted)
3.4.2.1 Rendered 3D Images
3.4.2.2 Furniture Layout
3.4.2.3 Detailing of Finishes
3.4.2.4 Ceiling and Plaster Details

3.5. After the final delivery, the CONTRACTING PARTY has up to 7 days to return with correction requests regarding technical issues. After this period, the contracted service is considered finalized.

3.6. After contracting the service, the CONTRACTING PARTY has until the presentation of the first proposal (item 3.1.1) to cancel the contract and receive a full refund of the total amount paid.

3.7. Between the presentation of the first proposal (item 3.1.1) and the approval of the 3D Facade (item 3.1.6), the CONTRACTING PARTY may cancel the contract and receive a 50% refund of the total project value.

Clause 4 – Responsibilities of the CONTRACTING PARTY

4.1. Before finalizing the contract, the CONTRACTING PARTY is responsible for gathering information about:

4.1.1 - Land (property registration with dimensions, shape, and other information requested by the CONTRACTED PARTY).
4.1.2 - Setbacks, construction norms, and regulations required by the local government and the property’s homeowner association.

4.2. Our projects comply with ABNT standards and sanitary regulations. If the CONTRACTING PARTY provides construction norms after the project update stage (item 3.1.2) and adaptations are required for project approval, additional fees will apply.

4.3. If the information outlined in item 4.1 is incorrect or not provided, it is the CONTRACTING PARTY's responsibility to adapt the project for approval.

4.4. For project approval and construction monitoring, a local professional must be hired, and this service is the responsibility of the CONTRACTING PARTY.

4.5. The CONTRACTING PARTY must hire a qualified professional to carry out and develop the structural project, which will include information about the dimensions, quantities, and placement of pillars, beams, footings, and reinforcements.

4.6. All requests and information submissions must be made via email. Contact via phone and WhatsApp is solely for clarification purposes.

Clause 5 – Responsibilities of the CONTRACTED PARTY

5.1. The CONTRACTED PARTY reserves the right to terminate this agreement in cases of technical infeasibility, with a full refund of the payment made, without any additional damages.

5.2. The CONTRACTED PARTY is not responsible for non-approval by the Municipality or Homeowner Association (item 4.3).

5.3. The CONTRACTED PARTY commits to following the information outlined in items 2.1 (requests by the CONTRACTING PARTY) and 4.1 (information provided).

Clause 6 – Payment Terms

6.1. Payment can be made via bank slip, credit card, or debit card using the PagSeguro, Mercado Pago, or PayPal systems where the CONTRACTED PARTY is the account holder.

6.2. Payment can also be made via bank transfer to an account where the CONTRACTED PARTY is the account holder.

Clause 7 – Disputes

7.1. To resolve any disputes arising from this agreement, the parties elect the court of the comarca of Araçatuba/SP.

Clause 8 – Contact

8.1. All contact must be made through tools available on the website or email, both with the domain archedesignstudio.com, registered by the CONTRACTED PARTY.

Delivery Policy

Our company works exclusively with infoproducts, or digital products. Where the customer immediately receives authorization to consume our services/products in the Members Area, via confirmation email. And the projects from our Store will also be delivered via email, in digital PDF and DWG format.
